The Court of Appeal heard the HM Revenue & Customs appeal in the Debenhams
merchant charges case in the middle of June.
The case centred on the implementation of trade terms whereby when paying by
credit / debit card part of the payment became consideration for the VAT exempt
supply of card handling services by another company.
The Court of Appeal decided Debenhams should pay VAT on all monies received
from customers. It is not yet know whether leave to appeal to the House of Lords
will be given.
