It appears that recent Court of Appeal cases have overturned the application of the 3 year cap to period prior to its introduction in 1996 and 1997.

VAT Newsflash - Halifax: The End of VAT Avoidance?
The ECJ delivered a decision yesterday that could spell the end of VAT avoidance schemes that have no other commercial justification. The case, involving Halifax Building Society (as was) appears to introduce into British VAT law an "abuse of rights" principle.

VAT Newsflash December 2005
The long awaited change to the rules about claiming VAT mileage allowances paid to employees have been announced by HMRC. Plus a change to the upper limit of the Annual Accounting Scheme.
2005 Pre-Budget Report
The Pre Budget Report sees few actual changes to VAT for the vast majority of businesses. There are 2 new consultations announced, proposed changes to the Option to Tax rules, good news for insurance companies and changes that will affect bookmakers and amusement arcades.
December 2005
November saw developments in VAT affecting hotels, internet retailers, the issue of securities and theatres. There are also rumours about the VAT rate and the criminalising of VAT avoidance.
